Because I am considering NOT paying anything more on one - only one - of my credit cards. Why?

1. My divorce case is dragging on and on (and on...) - I'm two years into litigation for a marriage that lasted only 3 1/2 years. She doesn't need the money but the court is forcing me to pay her $1,200/month anyway and no, we had no kids and yes, all of the property is mine and was before the marriage. But still she will NOT settle, firing her first attorney after he tried to make a deal with my lawyer and I. Meanwhile, my legal bills keep coming in. Almost forgot: I am forced by the court to keep her on my Blue Cross PPO, which costs me an additional $300/month. The sick part is that her employer offers her benefits but since she declines them and keeps on mine, they cut her a check for $500 in extra income each month.

2. My employer is now forcing furlough days on us all, which in my case translates into a pay cut of $533/month for the next three months. It will hit me hard given that my divorce case shows no signs of ending anytime soon.

3. I'm not sure anything too bad will happen to me. Yes, my credit will get wrecked but I'm not sure it matters much anymore. I tried to re-fi my house and my HELOC a few months ago but in both instances the costs were absurd and the monetary benefits were very minimal. That I pay all of my bills on time didn't matter at all.

Stuff I wonder about:

A. If I just quit paying the one card and default on it, will I lose the other one even though I am making the payments there? Will the lender on my HELOC do anything bad to me?

B. If I stop paying the one - and I'm only thinking of the one that moved its call center to India and that NEVER helps me with a dispute - does that make me an immoral person and a thief?

Please tell me what you think. I hope I don't get flamed too bad for even thinking about doing this but between the court system running a fence post up my bum (and I even when I tell them of my hardships, they don't even care) and my pay being cut, I just can't keep going on like I have: never able to save, always living on the edge, selling off all of my coins and my guns, etc. There's just no end in sight.

Thoughts? Opinions? Advice?

Sorry for the slow reply. I can undertand the stress you're under. I feel for you.

Cargo ships at sea have the authority to dump sea containers if they need to in order to maintain the viability of the ship (in a storm, etc.). In fact, shippers are required to have insurance for just that event.

The ship agrees to deliver your stuff.

Does it make them immoral to dump your stuff in the ocean in order to save their lives?

I don't think not paying one card will endanger any of the others. Generally those contracts will have provisions for the lender to have "recourse" if you're not current with their loan. It would be unusual (or a new thing) for there to be a provision to allow them to seek recourse from you for not paying somebody else when your loan with them is current.

I wouldn't worry about that.

I'm pretty sure it's a scam (although I don't know how) but you might consider talking to one of the "agencies" who help renegotiate debt, lower interest rates, get some forgiven etc..

The fact that you're grappling with the question at all says that you're not comfortable with the idea of just walking away from a debt.

You'll get no judgement from me, no matter what you do, but be sure you're comfortable with whatever you do 'cuz I'd had to see it bothering you later....

Thanks for your input, Carl, it's very gratefully appreciated.

I'm still mulling this move over but so far, I'm more inclined to keep paying and just try to muscle my way through it. Mere mention of my thoughts on this subject in a recent phone conversation with my mom nearly sent her into shock. "We pay our bills in this family," she said. I know I'd be letting her down if I defaulted and I don't think I can do that. I've just gotta' make it through, somehow.

One thing that recently occurred to me was this: it's always possible that I may become one of the nation's unemployed in another year or two. If I apply for a new job somewhere/anywhere else a credit default would get me popped on a background check - a disqualifier with serious damage potential. Long-term I might be doing myself much greater harm than initially thought.

Scott,

You make excellent posts. My folks wouldn't understand the point either.

As I read your post, I thought of the concept of "Golden Handcuffs" where highly compensated people get trapped in their jobs 'cuz of the mortgage on the big house, the summer place, the Porche, etc.. They can't leave their highly compensated jobs 'cuz they can't pay.

I realized that we ordinary folks have handcuffs too but they're the ordinary steel kind....

Very true.

Hey, as an addendum I do have a little bit of good news: I'm getting a substantial tax refund from both the state and the feds. In practical terms what it means is that I can pay one card off completely, and then have a few hundred left over to go after the second card.

This is the first good news I've had in a year. I would have said my Pilipina girlfriend was the first good news in the past year, but she summarily dumped me in an irrational fit of jealousy 10 days ago. = (

Looks like I need to take a trip to Asia somewhere. Maybe once the cash flow improves...
